Abstract
This work deals with the application of article 1.276 of the Civil Code, the norm states that the urban real estate is transmitted to the property of the Municipality or Federal District, after three years, when abandoned by the owner with the intention of no longer have it as his personal assets and if it is not held by another person. The article had little use in Brazilian legal order. This work is mainly practical and seeks to explore possibilities of its application, it presents an annex with a proposed bill that could give effectiveness to the article, as well as a body of comments divided into means of applying the project, the basis of its use and a set of relevant legislation about the article.
