LIMITES CONSTITUCIONAIS DO HUMOR E DA LIBERDADE DE EXPRESSÃO NA JURISPRUDÊNCIA
Abstract
The article analyzes some of the varied meanings that the word humor implies in the Portuguese language, but shortly afterwards it deals with the constitutional limits imposed in Brazil on the exercise of the right to freedom of expression, including in its aspects of humor, parody and sarcasm. Ahead, it examines the two most important precedents in STF jurisprudence already issued in the 21st Century, concerning freedom of expression and freedom of the press. Next, it addresses three precedents of the STJ in which legal confl icts arising from humorous matters and programs were settled, including the use of parody or sarcasm. In continuation, it deals with a precedent of TRF2, relative to a picture displayed in a traditional humorous program with a large
national audience. It also addresses the recent criminal conviction imposed on the comedian Danilo Gentili, and concludes with refl ections on the legal or normative acts that impose limits on the freedom of expression to the judges.
