O VIÉS DE CONFIRMAÇÃO NA DINÂMICA PROBATÓRIA DO PROCESSO PENAL
Abstract
O objetivo deste artigo é analisar os efeitos do viés de confi rmação no processo penal,
notadamente na fase probatória. Examina-se como as heurísticas e os vieses cognitivos podem
infl uenciar a tomada de decisão no campo jurídico, desafi ando o modelo estritamente racionalista
tradicional. Inicialmente, examinam-se os fundamentos teóricos relacionados às limitações da cognição
humana. Em seguida, analisa-se o funcionamento do viés de confi rmação, com destaque para
sua defi nição e suas características. Na sequência, aborda-se a relação entre o viés de confi rmação
e a prova pericial, bem como sua interface com a fi gura do Juiz das Garantias. Por fi m, a análise
recai sobre o reconhecimento pessoal e a prova testemunhal, examinando os impactos do viés
de confi rmação na forma como essas provas são buscadas, avaliadas e interpretadas. Trata-se de estudo
qualitativo, de natureza exploratória e descritiva, desenvolvido segundo o método hipotéticodedutivo,
com base em revisão bibliográfi ca e análise documental. Conclui-se que esse viés pode
incidir sobre a dinâmica probatória do processo penal, o que exige a implementação de medidas
normativas e institucionais voltadas à mitigação de seus efeitos.
